just to finish this off and say in the end ....I had to start ( as originally recommended by everyone ) from scratch on the new NAS recreating all my shares / accounts and settings ( no big deal really ) I then migrated all my data across from an external backup drive using robocopy on a network connected PC where I had already backed the data from the TS-110 too. Robocopy this time preserved all my file attributes such as file creation date ( useful to know when a photo was taken ) so nothing was lost.

Hope this is helpful for anyone else as migrating the drives from an old TS-110 to TS-228 was definitively not possible in my case..you just have to start again as it see's your old drive as a legacy volume...maybe if I had created the NAS data under a later firmware it would have been ok but this TS-110 was built over 10 years ago so that wasn't going to happen in my case.
